Transfer of Risk and Title Her Startup™ may send courtesy gifts/prizes to guests/members via shipping company or postal service. The delivery of such gift from Her Startup™ to the shipping company or postal service ends our liability and the risk of loss and title for your gift passes to the carrier. Virtual Events, Advertising, and Other Services Forms must be completed in their entirety, signed, and submitted along with payment before services begin. Any footage submitted will not be returned. Client submits material for storage and processing at its own risk. Her Startup™ liability for any damages, indirect or otherwise, including without limitation loss of profits, data, damage or destruction of materials is limited to the replacement of a similar quantity and quality of blank disc. Media and promotional materials submitted shall have no further liability. If goods/services are found to be defective and/or do not function properly due to technical difficulties, Client agrees to notify Her Startup™ in writing within thirty (30) days of such ocurrence. Her Startup™ liability shall be limited to the cost of services only. Client also acknowledges that Her Startup™ may at its sole discretion, subcontract part or all such services to be provided. Client further agrees to hold harmless the subcontracted party Challenge of Service If for some reason there is a disagreement relating to services Her Startup™ provides, the challenge of service can be submitted to confidential arbitration in St. Louis, Missouri. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under these Terms and Conditions of Use shall be joined to an arbitration involving any other party subject to these Terms and Conditions of Use, whether through class arbitration proceedings or otherwise.
